Storage Terms: Boat Seasonal storage starts October 1st and ends April 30th the following year, even if you pull your boat out early. Trailer Season Storage starts April 30th and will end October 31st, even if you pull your trailer out early. Any extension beyond this commitment will be charged at the monthly rate. We reserve the right not to release your boat/trailer until the balance is paid in full.
Notice to Terminate: Northwest Water Sports may terminate the tenancy or modify the terms of this Agreement by giving the Tenant 30-days’ written notice to the address on file. The tenant may terminate the tenancy by giving Northwest Water Sports a 30-day written notice but after the Six-Month minimum tenancy has been completed.
Ownership Certification: You certify that you are the registered owner of the boat and that you have full authority to authorize storage and request work on the boat. Should we be made a party to any litigation in connection with the boat, you agree to pay all costs and expenses, including attorneys’ fees and costs, for which we may be deemed liable or may incur in consequence of litigation.
Insurance: You certify that the boat is fully covered by insurance, for fire and extended coverage casualty insurance, and you warrant that you will continue to carry full insurance on the boat, Neither the boat nor any mariner or electronic equipment, clothing, personal effects, gear, boat trailer, motor or other items not owned by us will be insured by us for the benefit of you or any other person against loss or damage from any cause, including without limitation theft, pilferage, vandalism, fire, and the elements. You release us, the storage building owner, agents, and employees from any and all liability to you and/or anyone claiming through or under you by way of subrogation or otherwise, for any loss or damage to property caused by or resulting from risks insured against under fire extended coverage casualty insurance carried by you and enforced at the time of any loss or damage. You agree that you will cause your insurance carrier to include in your policy a clause or endorsement releasing the right of subrogation against us.
Limitation of Liability: We shall not be liable for any damage, loss, or injury to the boat, nor to any equipment, instrument or other property, except that caused by our failure to exercise reasonable care, and we shall not be liable for any damage, loss or injury which could not have been avoided by your exercise of care, or which is caused by the actions of any persons which are not our employees. We will not be liable for any damage, loss or injury caused by a condition on our premises. No liability of us to you under this paragraph shall exceed the sum of five hundred dollars ($500.00), unless you request that our limitations of liability be increased to a higher declared value, and agree to pay an increased charge based on such additional valuation. You must give written notice to us of any claim for damage, loss or injury within thirty (30) days after the basis for the claim becomes known or reasonably should have been known to you.
